Terms of sale

The following “general terms and conditions of sale” (hereinafter referred to as the GTC) apply to all orders placed on the website www.bonnegueule.fr. French law applies to all orders placed on the Site, regardless of the country of delivery chosen by the customer.

The website www.bonnegueule.fr is edited and operated by BG SAS GROUP, registered in the RCS of Paris under SIRET N° 790 674 873 00142, with its head office located at 226 rue Saint Denis, 75002 Paris, France. Its phone number is (+33) 9 78 46 86 28, and its VAT number is FR17790674873.
Any order that does not correspond to retail sales and, more generally, any fraudulent order may be refused.
By checking a box provided for this purpose, the customer acknowledges having read the GTC before placing the order and having accepted them without reservation.


Product Description

Each product we market is one that we love. We put all our attention into it and try to describe it as best as we can. However, the photographs or presentations cannot be contractual, as materials interact with their
environment. Colors vary according to light, the use of natural dyes like indigo or vegetable-tanned leather, making two products always slightly different. Handwork also gives each product a unique character.
We always strive to describe the product to the best of our ability, but it is your responsibility to ensure that the product meets your needs.


Product Availability

Collaborations with designers are made in limited quantities. Unless an exception is noted, no restock is planned. First come, first served. Some collaborations may be reissued following high customer demand.
The Bonnegueule clothing line is available continuously. As soon as stock levels approach depletion, we start a new production. It is therefore possible that a piece may be unavailable depending on demand, awaiting restock. You can request to be informed of a product restock via the “Back
in Stock” feature: by submitting your email address, you will be informed of the product’s availability as soon as it is restocked by email.
If one or more items are unavailable after an order has been placed on the site, you will be informed as soon as possible by customer service. If one or more items are unavailable, the order will be refunded using the original payment method.
Some products may be offered for pre-order: they are thus offered on the site in advance. In this case, the customer is informed by a specific "Pre- order" button, and the expected availability date of the product is indicated on the product page and in the cart before order confirmation.


Prices

For orders in France and Eurozone countries of the European Union, prices are inclusive of tax (all taxes included), excluding any potential delivery and transportation fees. These are mentioned before order confirmation and billed in addition, unless stated otherwise.
For orders in the United Kingdom, prices are listed excluding tax in British Pounds.
For orders in Switzerland, prices are listed excluding tax in Swiss Francs (CHF).
For all other delivery countries, prices are listed excluding tax in U.S. Dollars.
All payments are made in full, without the option of installment payments, unless an exception is specified on the purchase page (installment payments).
Prices may be offered in a currency different from the one used in your country. It is your responsibility to check applicable fees and exchange rates when placing an order, particularly regarding the payment method you wish to use.
Prices may be modified at any time. Only the price displayed on the summary page at the time of placing your order is applicable.

Customs Duties

Depending on the delivery country selected, customs duties may apply to your order. Bonnegueule offers a DDP (Delivered Duty Paid) delivery
service for the United Kingdom, meaning any customs fees are covered by Bonnegueule. There are no additional customs fees to pay upon receiving your order.
For other countries subject to customs duties, these remain the responsibility of the buyer and will be requested by the carrier upon delivery.


Local Taxes


Local taxes may apply depending on your delivery country or city. These taxes remain your responsibility.
Tax-Free Shopping : The tax-free service is not available for purchases made on the Site.

Order Process

Once we have the necessary information to (1) issue the invoice for your order, (2) identify you as the person placing the order, and (3) enable us to process the delivery, we will offer you different delivery options. You will need to choose one that will be billed at the price indicated.
You will then be asked to select the payment method you wish to use.
Unless otherwise stated, all transactions are made by credit card or PayPal. You may be subject to specific conditions related to the payment method you choose.
All these payment methods are processed by third-party companies.
Therefore, we never have access to your banking data.
Additionally, to combat fraud, we have implemented order verification procedures. These procedures may allow us to block or, if necessary,cancel an order if fraud is detected. You will then be notified by email at the address you provided. If this cancellation is unfounded, please do not hesitate to contact us.
To finalize the order, you must click on “I confirm my order.” You acknowledge that placing an order implies an obligation to pay. Failure to make payment will prevent the order from being processed.
Your confirmation of the order constitutes full acceptance of the GTC previously outlined and results in the conclusion of a contract between BG GROUP SAS and yourself.
You will then be immediately provided with an order number.
A confirmation email of the order, your acceptance, and payment will be sent by Bonnegueule as soon as possible to the email address you provided during the ordering process. A second email will be sent to the same address, enabling you to track your package.
An electronic invoice will be sent by email after the order is confirmed.
In the event that these emails are not received, the customer is advised to check their spam folder. The customer is informed that emails are sent to the address they provided. Therefore, if there is an error in the email address, or if the confirmation email or shipment email is not received,
Bonnegueule cannot be held responsible.


Payment


Orders can be paid:
• By credit card (cards from the CB, Visa, Eurocard/Mastercard, American Express, Bancontact, and Maestro networks (for Belgium) are accepted). In this case, the customer’s credit card will be charged when the order is placed.
Payment is made on our site via Adyen. The ADYEN company adheres to the SSL security standard. Your confidential data is transmitted after encryption to the ADYEN server and is never transmitted to our server. The ADYEN server itself is connected to the bank servers of each concerned country.
• Via the customer’s PayPal account. When choosing PayPal as the payment method, you will automatically be redirected to your PayPal account.
• Through the Alma installment payment service (available in France and Belgium). When choosing this payment method, you will be redirected to a profile validation page to allow our partner Alma to confirm the request.
Your information will be transmitted to Alma, who, subject to the acceptance of your application, will provide a payment schedule summarizing the amounts of the various installments. By choosing this installment payment method, you accept Alma’s general customer terms.
• By gift card: the gift card can be used as full or partial payment of your order, depending on the amounts. See the section dedicated to gift cards below.
Secure Payment
All transactions on the Site are conducted securely.
Credit card details are encrypted using SSL (Secure Socket Layer) protocol and are never transmitted in clear text over the network. Payment is made directly with the bank, and we never have access to these details.
Final Agreement on Payment of the Order
Customers are reminded that confirming an order constitutes an obligation to pay the agreed-upon price, and once the order is confirmed, the customer can no longer cancel it, subject to exercising their right of withdrawal (see Article 7 below).
Bonnegueule reserves the right to suspend or cancel the execution of an order and/or delivery in the event of non-payment, partial payment of the price, payment incidents, or fraud or attempted fraud related to the use of the site, including for previous orders.

Delivery


Delivery Areas

The Site offers international delivery.
If your country is not listed among the available countries when entering the delivery address, we invite you to contact Customer Service, who will review your request.
Unless otherwise stated or agreed upon, we commit to delivering the products you ordered within fourteen (14) calendar days after payment of the order.
Digital products and access to subscribed services are instantly delivered via email at the time of purchase.
Delivery is made by transferring physical possession or control of the Product and will be delivered to the address you provided; this constitutes a transfer of ownership unless installment payments are made. You acknowledge that ownership of the item can only occur upon receipt of full
payment by BG GROUP SAS.
The delivery of the Product(s) will be made either to you or to a third party you have designated.

The Site offers the following delivery options:

Delivery rates and methods vary depending on the selected delivery area:


Mainland France, Monaco
• Colissimo (home/work, post office, pick-up point/locker):
Cost: Standard delivery is free for purchases over €200 (otherwise, €5).
Delivery time: 2 to 3 working days after dispatch.
• Mondial Relay:
Cost: Free delivery for purchases over €200 (otherwise, €3).
Delivery time: 3 to 5 working days after dispatch.
• TNT Express 24-hour delivery:
Cost: €9.


France Overseas Territories (DOM-TOM)
Delivery method: Delivery is made by Colissimo.
Cost:
•Guadeloupe, French Guiana, Martinique, Mayotte, La Réunion, Saint-
Martin, Saint-Pierre-et-Miquelon, Saint-Barthélemy: €15.
•French Southern Territories, French Polynesia, New Caledonia: €25.
Delivery time: 5 to 7 working days after dispatch.


European Union
• Delivery by Colissimo to home or pick-up point, followed by local postal
service.
Cost: Free for purchases over €200 (otherwise, €15).
Delivery time: 3 to 8 working days (depending on destination).
• Delivery by Mondial Relay available in Belgium, Spain, Austria, Germany,
the Netherlands, and Portugal.
Cost: Free for purchases over €200 (otherwise, €10).
Delivery time: 3 to 5 working days (depending on destination).


Switzerland
• Delivery by Colissimo International, followed by local postal service.
Cost: €15 for any order.
Delivery time: 3 to 8 working days.


United Kingdom
• Delivery by DHL.
Cost: €15 for any order.
Delivery time: 3 to 8 working days.
Non-EU Countries
• Delivery by Colissimo International, followed by local postal service.
Cost: €30 for any order.
Delivery time: 1 week (depending on destination).


In-store Delivery
In the case of in-store delivery, your order is prepared within 24 to 48 working hours if the item is available in stock at the store selected for collection. If the ordered item is no longer available in stock at the selected store, another store with the item will ship it to the designated store for collection. With this shipping method, the preparation time may be slightly longer, but it ensures that you receive the item.
You will be notified by email when your order is ready for pickup, and you can collect it during the store's opening hours. Your order will remain available at the store for 15 days.


Reservations
In the event of a delivery anomaly (damaged package, missing package, damaged product, missing product), you must:
•Make all necessary reservations on the delivery receipt provided by the carrier before signing it or refuse delivery;
•Inform Customer Service of any delivery issues with the products within 24 hours of receipt (without prejudice to the possibility for the customer to send a registered letter to the carrier within the three- day period provided for by Article L.133-3 of the French Commercial Code, in which case the customer agrees to send a copy to Customer Service to allow them to initiate an investigation with the carrier). Without this, no claim regarding a delivery anomaly will be considered valid by Bonnegueule.
It is noted that in the case of a lost package during transport,
investigation times may take one to three weeks.
In the case of incomplete or inaccurate addresses or missing
information preventing the delivery of the product to the recipient within the originally agreed time frame, Bonnegueule cannot be held responsible for the non-delivery.
In the event of the recipient's absence at the time of delivery, the carrier will leave a delivery notice in the recipient's mailbox. The recipient must then collect the package at the address specified on the delivery notice, presenting the notice and an identity document in the name of the person collecting it.


Gift Cards


Gift cards purchased on the Site are valid for 1 year on all products offered on the Site, as well as in our stores, upon presentation of the code received by email.
Gift cards can be combined with promotional offers. A gift card cannot be used to purchase another gift card. Gift cards are neither exchangeable nor refundable, even partially, for any reason whatsoever (including theft, loss, damage, or expiration).
In case of loss or forgetting the gift card code, we invite you to contact customer service.


Customer Account

You can create a user account on the Site, but it is not mandatory, as you can place orders in “guest mode.”
Creating an account is mandatory to benefit from the loyalty program and other features offered by the customer account, such as access to order history.
You agree to provide us with true, accurate, and sincere information and to regularly update it.
It is your responsibility to implement all necessary measures to preserve the security of your credentials, including entering a strong and complex password, maintaining confidentiality, and regularly changing your password. Any connection using your credentials will be presumed to be made by you, and any action on your account may engage your responsibility, except in the case of a fault on our part. In the event of fraudulent use of your account, we kindly ask you to inform us as soon as
possible.
In case of loss or forgotten password, you can reset it by following the dedicated procedure on the Site.


Loyalty Program

By creating an account on our Site, you join our loyalty program. This omnichannel loyalty program rewards your purchases and interactions with the brand, both online and in-store.
You can accumulate points through various actions, provided these actions are carried out while logged into your account.
Points are awarded based on the following scale:
• Creating an account: 25 points
• Following the Instagram account: 10 points
• Visiting the TikTok page: 10 points
• Providing your birthday: 50 points each year
• Publishing a review (limited to one review per hour): 25 points
• In-store or online purchases: €1 spent = 1 point
Points related to a purchase are rounded down to the nearest euro and are based on the amount paid by the member, net of discounts and rebates.
The validity period for your points is 1 year from the date of your last points earned.


You can check your points balance in your account on the Site or on the loyalty program page. Once a certain threshold is reached, your points can be converted into discount vouchers to use on our Site, with amounts and conditions varying depending on the number of points converted:
•€10 off for 200 points
•€15 off for 300 points
•€20 off for 400 points

The available discount amount based on your points will be displayed on the payment page and will allow you to automatically apply the discount to your purchase. In the event of a display or usage issue with the discount, we invite you to contact customer service.
In-store, any discounts available on your customer account will be offered at checkout, provided you have previously provided the email address associated with your customer account.
The discounts awarded through the loyalty program can be combined with other current offers but cannot be combined with discount coupons and are only usable once. Your points can be accumulated to reach a higher discount level if you wish, within the points validity period.
In the event of a return, the points associated with the purchase will automatically be deducted from your account.
Points are personal, nominative, and reserved for individual, non-professional use. They cannot be transferred, passed on to a third party, exchanged for money, or resold.

Customer Reviews

You can read customer reviews about the products on the Site. Reviews are sorted from most recent to oldest under the corresponding product page. The opinions and recommendations expressed for each product are solely those of their authors and do not constitute a contractual obligation
regarding the order.
If you place an order on our Site, you will receive an email after the delivery of the products requesting your review on the product(s) ordered and your shopping experience on the Site.
Customers who receive this email and provide a review on the Site are considered "Verified Buyers."
You are invited to give a rating out of 5 stars and provide a comment.
You also have the option to write a review directly from the product page. In this case, a confirmation email will be sent to validate that you are indeed the author of the review, ensuring its authenticity. After submitting the form, your review will be published on the Site under the corresponding product page.
Some reviews are randomly selected to appear temporarily in a carousel at the bottom of each webpage of the Site.
Submitting a review does not entitle you to any compensation, except as provided in the loyalty program.
Reviews cannot be modified.
Reviews remain on the Site until the product is no longer listed. We reserve the right to remove any review for legitimate reasons (defamatory, offensive, insulting, contrary to public decency, irrelevant to the product, non-compliant with GDPR or third-party rights, etc.). In such cases, we will inform you by email of the reasons justifying the rejection of
your review.


Bonnegueule Guarantees


We take pride in our products and services, and we always strive to maintain the highest level of care. Our clothing is produced in partner workshops, mainly in France or within the European Union. This way of producing allows us to guarantee products of impeccable quality.
However, if some defects escape our attention, please do not hesitate to contact us. We will make it a point of honor to refund you. That is why:
All our physical products are guaranteed "satisfied or refunded," provided they are returned in perfect condition within 30 days of receipt. 
All our digital products (books and digital services) are guaranteed "satisfied or refunded" within 30 days of purchase. Upon simple request, the product will be refunded directly to your account.

Legal Guarantees

The legal guarantees apply independently of any commercial guarantee that may be granted (Bonne Gueule guarantees).
In accordance with French law, if you are a consumer as defined by the Consumer Code and provided that BG GROUP SAS is the seller from whom you purchased the goods or services, we are responsible for any defects in the conformity of the goods to the contract under the conditions set out in Article L. 211-4 and following of the Consumer Code, and for hidden defects in the item sold under the conditions provided for in Articles 1641 and following of the Civil Code.

Legal Guarantee of Non-conformity

The seller is required to deliver a product that conforms to the contract and is responsible for any non-conformities existing at the time of delivery. The seller is also responsible for any non-conformities resulting from the packaging, assembly instructions, or installation when the contract specifies these were to be performed by the seller or under their responsibility.

For the product to be in conformity with the contract, it must:

1° Be suitable for the purpose usually expected of a similar product and, where applicable, correspond to the description provided by the seller and have the qualities presented to the buyer in the form of a sample or model, as well as the qualities a buyer may reasonably expect given public statements made by the seller, producer, or representative, particularly in advertising or labeling;

2° Or possess the features defined by mutual agreement between the parties, or be suitable for any special use sought by the buyer, brought to the seller’s attention, and accepted by the latter.
Actions based on non-conformity defects must be initiated within two (2) years of the delivery of the goods.
You may choose between the repair or replacement of the product, subject to the cost conditions provided for in Article L. 211-9 of the Consumer Code. You are not required to provide proof of the existence of the non-conformity defect during the six months following the delivery of the product. This period is extended to twenty-four months as of March 18, 2016, except for second-hand goods.

Legal Guarantee Against Hidden Defects of the Sold Item


The seller is liable for hidden defects in the sold item that render it unfit for the use for which it was intended or which reduce such use to the extent that the buyer would not have acquired it, or would have paid a lower price, had they known about the defects.
Actions based on redhibitory defects must be initiated by the buyer within two (2) years of discovering the defect. You can then choose between canceling the sale or a price reduction in accordance with Article 1644 of the Civil Code.


Exclusion of Guarantees

Items that have been modified or repaired by the customer are excluded from the guarantee. Similarly, the guarantee will not apply to apparent defects under Article 1642 of the Civil Code. Finally, the guarantee will not cover items damaged during transportation or due to improper use.


Right of Withdrawal

Withdrawal Period

You have the right to withdraw from this contract without giving any reason within thirty (30) days.


Notification of Withdrawal
In the event of a withdrawal (for example, if you purchased the wrong product), contact us by email as soon as possible to avoid shipping and to find a solution together. If the product has already been shipped, we will apply the standard return conditions upon its receipt (return shipping costs will be covered).
The withdrawal period expires thirty (30) days after the day you, or a third party other than the carrier and designated by you, take physical possession of the goods or the last goods.
To exercise your right of withdrawal, you must notify us of your decision to withdraw from this contract by means of a clear statement (for example, a letter sent by post, fax, or email). You may also complete and submit the following model withdrawal form:

If you use this option, we will send you an acknowledgment of receipt of the withdrawal on a durable medium (e.g., by email) without delay. To meet the withdrawal deadline, it is sufficient to send your communication concerning the exercise of the right of withdrawal before the withdrawal period expires.

Return Procedure
For orders placed on the Site:
You can use the return portal accessible from the footer of the website or from your customer account. You will need to provide your order number and email address.
You can also contact Customer Service via email or the contact form.


A prepaid return label will be made available for France and Belgium. For returns from a country outside France and Belgium, a return label will be provided, and the return costs will be deducted from the refund.


Products must be returned within 14 days after the notification of the return request.
Clothing must be unworn, unwashed, unaltered, with their original tags and returned in their original packaging.


For purchases made in-store or via in-store pickup:
Your return must be made at the BonneGueule store of your choice.
Products must be returned within 14 days after the purchase or pickup date.

Effects of Withdrawal
If you withdraw from this contract, we will refund all payments received from you, including delivery costs (except for any additional costs arising if you chose a delivery method other than the least expensive standard delivery option we offer) without undue delay and, in any event, no later than fourteen (14) days from the day we are informed of your decision to withdraw from this contract. We will make the refund using the same payment method you used for the initial transaction, unless you expressly agree to a different method; in any case, you will not incur any fees as a result of the refund.
We may withhold the refund until we have received the goods back or until you have provided proof of sending the goods back, whichever is earlier.
You must return or hand over the goods to us without undue delay and, in any event, no later than fourteen days (14) after you have communicated your decision to withdraw from this contract. The deadline is met if you send the goods back before the fourteen-day period has expired. You will bear the direct cost of returning the goods.
We may refuse to refund you in whole or in part for the product in the case of depreciation of the goods resulting from handling other than what is necessary to establish the nature, characteristics, and proper functioning of the goods.


Conditions Relating to the Right of Withdrawal
The following contracts are not subject to the right of withdrawal:
The provision of services fully performed before the end of the withdrawal period, where the performance has begun after the consumer's express prior agreement and the consumer has expressly waived their right of withdrawal;
The supply of goods made to the consumer's specifications or clearly personalized;
The supply of goods that have been unsealed or damaged by the consumer after delivery and which cannot be returned for health protection or hygiene reasons;
The supply of digital content not supplied on a tangible medium, where performance has begun after the consumer's express prior consent and the consumer has expressly waived their right of withdrawal.


Complaints
For any complaints, do not hesitate to contact us by email (client@bonnegueule.fr). We take pride in acting in a considerate and transparent manner towards all our customers, and we do our best to find a solution that satisfies you.


Non-waiver
The fact that we do not insist on strict application of one of the provisions of these Conditions does not imply a waiver of our right to invoke this provision later.
Proof - Electronic Communication
Any notification or communication between you and us may be made by electronic means and may be accepted as proof.


Applicable Law


Unless otherwise required by law, these Conditions are governed by French law.
The application of the law indicated above may be overridden in favor of the law of the buyer's country under the conditions provided for by Regulation No. 593/2008 of June 17, 2008, on the law applicable to contractual obligations.
Jurisdiction - Dispute Resolution
We would like to inform you that, under the amicable procedures to which any difficulty must be submitted before referral to the competent courts, we may, by mutual agreement, implement the means permitted by Directive 2013/11/EU of the European Parliament and of the Council of May 21, 2013, on the alternative resolution of consumer disputes and those resulting from Regulation (EU) No. 524/2013 of the European Parliament and of the Council of May 21, 2013, on online dispute resolution for consumer disputes.
In the event of a claim that is not resolved amicably by our Customer Service, and in accordance with Article L612-1 of the Consumer Code, the Client may freely use the mediation service of CM2C, to which BG Group is affiliated, via electronic means at the address https://cm2c.net/. The mediator service can be contacted for any consumer dispute that has not been successfully resolved.
Unless otherwise required by law, any dispute not resolved through an amicable procedure is subject to the competent court of the Paris Court of Appeal, which has jurisdiction, even in cases of emergency, third-party claims, or multiple defendants.
