TERMS OF SALES

These “General Terms and Conditions of Sale” (hereinafter the GTC) apply to all orders placed on the website www.bonnegueule.fr. French law applies to all orders placed on the Website, regardless of the country of delivery selected by the customer. 
The website www.bonnegueule.fr is published and operated by BG GROUPE, registered with the Paris Trade and Companies Register (RCS) under SIRET No.: 98859924700018, with its registered office located at 23 rue Nollet, 75017 Paris, France; telephone number: (+33) 9 78 46 86 28; and intra-Community VAT number: FR55988599247.

Any order that does not constitute a retail sale and, more generally, any fraudulent order may be refused.
By checking the box provided for this purpose, the customer acknowledges having read the Terms and Conditions before placing the order and having accepted them without reservation.

PRODUCT DESCRIPTION
Every product we sell is one we love. We’ve put our full attention into it and strive to describe it to you as accurately as possible. However, the photographs or descriptions of the product are not binding, as a material’s appearance is influenced by its environment. Colors vary depending on the light; the use of natural dyes such as indigo or vegetable-tanned leathers means that no two products will ever be exactly the same, and handcrafted details also give each product a unique character. We always strive to describe the product as accurately as possible, but it is up to you to ensure that it meets your specific needs and the intended use for which you plan to use it.

PRODUCT AVAILABILITY
Bonnegueule clothing is produced in limited quantities. When an item is popular, we sometimes restock it. You can request to be notified when a product is back in stock using the “Notify Me When Back in Stock” feature: by submitting your email address, you’ll be notified of the product’s availability as soon as it’s back in stock via an email sent to the address you provided.

If any of the items are unavailable following an order placed on the website, customer service will notify you as soon as possible. If one or more items are unavailable, the order will be refunded via the original payment method.
Some products may be available for pre-order: these are featured on the website as a sneak peek. In this case, the customer is notified via a specific “Pre-order” button, and the estimated availability date for the product is indicated on the product page and in the shopping cart before the order is confirmed.

PRICES
For orders in France and in Eurozone countries within the European Union, the prices listed include all taxes, excluding any applicable shipping and handling fees. These fees are displayed before the order is confirmed and, unless otherwise stated, are billed as an additional charge.
For orders to the United Kingdom, prices are listed in British pounds, excluding tax.
For orders to Switzerland, prices are listed in Swiss francs (CHF), excluding tax.
For all other delivery countries, prices are listed in U.S. dollars, excluding tax.
All payments must be made in full at the time of purchase; installment plans are not available, unless otherwise noted on the checkout page (payment in installments).
Prices may be displayed in a currency other than the one used in your country. You should check the applicable fees and exchange rates at the time you place your order, particularly with regard to the payment method you wish to use.
Prices are subject to change at any time. Only the price displayed on the summary page at the time you place your order is applicable.

CUSTOMS DUTIES
Depending on the selected delivery country, customs duties may apply to your order. Bonnegueule offers a DDP (Delivered Duty Paid) shipping service for the United Kingdom, the United States, and Canada: this means that any customs fees are covered by Bonnegueule. You will not have to pay any additional customs duties upon receipt of your order. For other countries subject to customs duties, these remain the responsibility of the buyer and will be collected by the carrier upon delivery of the order.


LOCAL TAXES
Local taxes may apply depending on your country or city of delivery. You are responsible for paying these taxes.


TAX REFUND
The tax refund service is not available for purchases made on the Site.

ORDER PROCESS
Once we have the information needed to (1) issue the invoice for your order, (2) identify you as the person who placed the order, and (3) arrange for delivery, we will offer you various delivery options. It will be up to you to choose one, for which you will be billed at the indicated price.
You will then be prompted to select your preferred payment method. Unless otherwise stated, all transactions are processed via credit card or PayPal. You may be subject to specific terms and conditions associated with the payment method you choose.
All of these payment methods are managed and provided by third-party companies. Therefore, we never have access to your banking information.
Additionally, to combat fraud, we have implemented order verification procedures. These measures may allow us to block and, if necessary, cancel an order if fraud is detected. You will then be notified by email at the address you provided. If this cancellation is unwarranted, please do not hesitate to contact us.
To finalize your order, you must click “I Confirm My Order.” You acknowledge that placing an order implies an obligation to pay. Failure to pay prevents the order from being processed.

Your confirmation of the order implies full acceptance of the Terms and Conditions set forth above and results in the formation of a contract between BG GROUPE SAS and you.
You will then immediately receive an order number. Bonnegueule will send an email confirming receipt of your order, your acceptance, and payment for the order as soon as possible to the email address you provided during the ordering process. A second email will be sent to the same address, allowing you to track your package.
An electronic invoice will be sent by email after the order is confirmed.
If you do not receive these emails, we recommend that you check your spam folder. The customer is informed that emails are sent to the email address they provided. Therefore, if there is an error in the email address provided, or if the message confirming the shipment or delivery of the order is not received, Bonnegueule cannot be held liable.

PAYMENT
Payment for orders can be made:
• By credit card (we accept CB, Visa, Eurocard/Mastercard, American Express, Bancontact, and Maestro [for Belgium]). In this case, the customer’s credit card is charged when the order is placed. Payment is processed on our website via Shopify Payments. Shopify Payments uses SSL security standards. Your confidential data is transmitted in encrypted form to the Shopify Payments server and is never transmitted to our server. The Shopify Payments server is itself connected to the servers of the banks in each relevant country.
• Through the customer’s PayPal account. If you choose to pay via PayPal, you will be automatically redirected to your PayPal account.
• Via the Alma installment payment plan (in France, Spain, Portugal, Germany, Italy, Belgium, the Netherlands, Luxembourg, Austria, and Ireland). When you select this payment method, you will be redirected to a page to verify your profile so that our partner Alma can confirm acceptance of your request. Your information will then be sent to Alma, which—subject to approval of your application—will provide you with a payment schedule detailing the amount of each monthly installment. By choosing this installment payment plan, you agree to Alma’s customer terms and conditions.
• By gift card: The gift card can be used to pay for part or all of your order, depending on the amounts. See the section on gift cards below.

Secure Payment
All transactions made on the Site are secure.
Credit card information is encrypted using the SSL (Secure Socket Layer) protocol and is never transmitted in plain text over the network. Payment is processed directly through the bank, and we do not have access to this information under any circumstances.

Final Agreement on Payment for the Order

Customers are advised that confirming an order constitutes an obligation to pay the agreed-upon price and that, once the order is confirmed, the customer may no longer cancel it, subject to the exercise of their right of withdrawal (see Article 7 below).
Bonnegueule reserves the right to suspend or cancel the fulfillment of any order and/or delivery in the event of non-payment or partial payment of the price, in the event of a payment issue, or in the event of fraud or attempted fraud regarding the use of the website, including in connection with previous orders.

DELIVERY
DELIVERY AREAS

The Site offers international shipping. If your country does not appear in the list of available countries when you enter your shipping address, please contact Customer Service, who will review your request.
Unless otherwise specified or agreed upon regarding the delivery date, we undertake to deliver the Products you have ordered within fourteen (14) calendar days after payment for the order. Digital products and access to subscribed services are delivered instantly via email at the time of purchase.
Delivery is effected by the transfer of physical possession or control of the Product and will be made to the address you have provided to us; it shall constitute a transfer of ownership except in the case of payment in installments. You acknowledge that the transfer of ownership of the goods may only take place upon receipt of the full Price by BG GROUPE SAS.
Delivery of the Product(s) will be made either to you or to the third party you have designated.

The Site offers the following shipping options:

Shipping rates and methods vary depending on the selected delivery area:

Metropolitan France, Monaco
Colissimo (home/office, post office, pickup point/lockers):
Cost: €6 for home delivery and €5 for pickup points.
Delivery time: 2 to 4 business days after shipment.

Mondial Relay:
Cost: Free delivery on orders of €200 or more (otherwise, €5).
Delivery time: 2 to 4 business days after shipment.

France and Overseas Territories
Shipping method: Shipping is via Colissimo.

Cost:
- Guadeloupe, French Guiana, Martinique, Mayotte, Réunion, Saint Martin, Saint Pierre and Miquelon, Saint Barthélemy: €15.
- French Southern Territories, French Polynesia, New Caledonia: €25. Delivery time: 5 to 7 business days after shipment.


European Union:
Delivery via Colissimo to your home or a pickup location, then via local postal service.
Cost: Free for purchases of €200 or more (otherwise €10)

Delivery time: 3 to 8 business days (depending on the destination).

Delivery via Mondial Relay is available in Belgium, Spain, Austria, Germany, the Netherlands, and Portugal.

Cost: Free for purchases of €200 or more (otherwise €8)
Delivery time: 3 to 5 business days (depending on the destination).

Switzerland:
Delivery via Colissimo International, then via the local postal service.

Cost: €15 for all orders.
Delivery time: 3 to 8 business days. 


United Kingdom:
Delivery via DHL.
Cost: €15 for all orders.
Delivery time: 3 to 8 business days.

United States and Canada:
Delivery via DHL.
Cost: $30 for all orders.
Delivery time: one business week

Countries outside the European Union:
Shipping via Colissimo International, followed by local postal service.

Cost: €30 for all orders. 

Delivery time: one business week (depending on the destination).


In-Store Pickup
For in-store pickup, your order will be prepared within 24 to 48 hours if the item is in stock at the store you selected for pickup. If the item you ordered is no longer in stock, a store that has it will ship it to the store you selected for pickup. With this shipping method, the preparation time is slightly longer, but it ensures you’ll receive the item.
You will be notified by email when your order is ready, and you can pick it up during our stores’ business hours.
Your order will remain available in-store for 15 days.

RESERVATIONS
In the event of a delivery issue (damaged package, missing package, damaged product, missing product), you must:
* note any relevant reservations on the carrier’s delivery slip before signing it, or refuse the delivery;
* notify Customer Service of any delivery issues regarding the Products within 24 hours of receipt (without prejudice to the Customer’s right to send a registered letter to the carrier within the three-day period provided for in the aforementioned Article L.133-3 of the Commercial Code; in such a case, the Customer agrees to forward a copy to Customer Service to enable it to conduct an investigation with the carrier) .
Failing this, no claim regarding a delivery issue will be considered valid by Bonnegueule. It is specified that, in the event of a package being lost during transit, the investigation may take one to three weeks.
In the event of an incomplete or incorrect address, or a lack of information resulting in the inability to deliver the Product to the recipient within the originally scheduled timeframe, Bonnegueule shall not be held liable for the failure to deliver. If the recipient is not present at the time of delivery—for deliveries handled by the carrier—the delivery person will leave a delivery notice in the recipient’s mailbox. The recipient must then pick up the package at the address specified on the delivery notice, upon presentation of If the recipient is not present at the time of delivery—for deliveries handled by the carrier—the delivery person will leave a delivery notice in the recipient’s mailbox. GIFT CARDS

Gift cards purchased on the Site are valid for 1 year on all products offered on the Site as well as in our stores, upon presentation of the code received by email.
Gift cards can be combined with promotional offers. A gift card cannot be used to purchase another gift card. Gift cards cannot be exchanged or refunded, even partially, for any reason whatsoever (including theft, loss, damage, or expiration).
If you forget or lose the code associated with your gift card, please contact customer service.

CUSTOMER ACCOUNT

You may create a user account on the Site, but this is not required, as you can place an order in “guest mode.”

Creating an account is required to participate in the loyalty program and to access other features offered by the customer account, such as your order history.

You agree to provide us with accurate, truthful, and reliable information and to update it regularly.

It is your responsibility to take all necessary measures to ensure the security of your login credentials by creating a strong and complex password, keeping them confidential, and changing your password regularly. Any login using your login credentials will be deemed to have been made by you, and you may be held liable for any action taken on your Account, unless we are at fault. In the event of fraudulent use of your Account, please notify us as soon as possible.

If you lose or forget your password, you can reset it by following the dedicated procedure on the Site.

LOYALTY PROGRAM
With every purchase on our website or in-store, you automatically earn loyalty points: 1€ spent = 1 point. You can also earn points by completing certain tasks (leaving a product review, leaving feedback on an in-store experience, entering your birthday, signing up for the newsletter).
Once you reach a certain threshold, you can redeem your points for a gift card to use on your next order. You’ll be notified by email, and you can redeem your gift card on this page or through your customer account.
The total points earned from a purchase are rounded down to the nearest euro and are based on the amount paid by the Member, net of any discounts or rebates.
Your points are valid for 6 months from the date you last earned points.

You can check your point balance in your Account on the Website or on the page dedicated to the loyalty program. Once you reach a certain threshold, your points can be converted into discount coupons redeemable on our Website; the amounts and terms vary depending on the number of points you convert:
* €20 discount for 400 points
* €50 discount for 1,000 points
The discount amount available based on your points will be displayed on the checkout page and will be automatically applied to your purchase. If you encounter any issues with the display or application of the discount, please contact Customer Service.
In-store, any discounts available on your customer account will be offered at checkout, provided you have previously provided the email address associated with your customer account.
Discounts earned through the loyalty program cannot be combined with other promotional codes; however, they can be combined with items marked down with a strikethrough price.

In the case of a full return:
Since a coupon is valid only once, it will not be reactivated upon refund. However, the points used will be restored, so you can use them on a future order by converting them into a new coupon.
In the case of a partial return:
For technical reasons, we are unable to reactivate your points in the case of a partial return. We therefore invite you to contact our customer service team so that we can manually restore your points on a pro-rata basis based on the items returned.

CUSTOMER REVIEWS
You can view customer reviews of products on the Site. Reviews are listed from newest to oldest under the corresponding product page. The opinions and recommendations expressed for each product are solely those of their authors and do not form part of the contractual terms of the order.
If you place an order on our Website, you will receive, after the products have been delivered, an email asking for your review of the product(s) ordered and your shopping experience on the Website.
Customers who receive this email and submit a review on the Website are considered “Verified Buyers.”
You are invited to give a rating out of 5 stars and to write a comment.
You also have the option to write a review directly from the product page. In this case, an identity confirmation email will be sent to you to verify that you are indeed the author of the review and to ensure its authenticity. After the form is validated, your review will be published on the Site under the corresponding product page.
Some reviews are randomly selected to appear temporarily in a carousel at the bottom of each web page on the Site.
Submitting a review does not entitle you to any compensation, except as provided for under the loyalty program.
Reviews cannot be edited.

Reviews remain on the Site until the corresponding product is removed from the Site.
We reserve the right to block and/or remove any comment for legitimate reasons (defamatory, abusive, or offensive language; content contrary to public decency; comments unrelated to the reviewed product; non-compliance with the GDPR or the rights of third parties; etc.). In such cases, we will notify you by email of the reasons for rejecting your review.

STATUTORY WARRANTIES

Statutory warranties apply regardless of any commercial warranty that may be provided (the Bonne Gueule warranties).
In accordance with French law, if you are a consumer as defined by the Consumer Code and provided that BG GROUPE SAS is the seller from whom you purchased the good or service, we are liable for any lack of conformity of the goods with the contract under the terms of Article L. 211-4 et seq. of the Consumer Code and for any latent defects in the item sold under the terms set forth in Articles 1641 et seq. of the Civil Code.

Statutory Warranty for Lack of Conformity 

The seller is required to deliver goods that conform to the Contract and is liable for any lack of conformity existing at the time of delivery. The seller is also liable for any lack of conformity resulting from the packaging, assembly instructions, or installation when such installation was the seller’s responsibility under the Contract or was carried out under the seller’s supervision.
To be in conformity with the Contract, the goods must:
1. Be fit for the purpose usually expected of similar goods and, where applicable, correspond to the description provided by the seller and possess the qualities that the seller presented to the Buyer in the form of a sample or model, and possess the qualities that a Buyer may legitimately expect in light of public statements made by the seller, the manufacturer, or their representative, particularly in advertising or on labeling;
2° Or possess the characteristics mutually agreed upon by the Parties or be suitable for any specific use sought by the Buyer, which was brought to the seller’s attention and which the seller accepted.
The right to bring a claim for lack of conformity expires two (2) years from the date of delivery of the goods.
You may choose between repair or replacement of the item, subject to the cost conditions set forth in Article L. 211-9 of the Consumer Code. You are not required to provide proof of the item’s lack of conformity during the six months following delivery of the item. This period is extended to twenty-four months as of March 18, 2016, except for used items.

Statutory Warranty for Hidden Defects in the Item Sold (Hidden Defects) 

The seller is liable under the warranty for hidden defects in the item sold that render it unfit for its intended use, or that so significantly impair such use that the Buyer would not have purchased it, or would have paid only a lower price for it, had the Buyer been aware of such defects.
Any claim arising from such defects must be filed by the Buyer within two (2) years of the discovery of the defect. You may then choose between rescission of the sale or a reduction in the sale price in accordance with Article 1644 of the Civil Code.

Warranty Exclusions  
Items modified or repaired by the customer are excluded from the warranty. Similarly, the warranty does not apply to apparent defects pursuant to Article 1642 of the Civil Code. Finally, the warranty does not cover items damaged during shipping or due to misuse.

WITHDRAWAL
Withdrawal Periods 

You have the right to withdraw from this contract without giving any reason within fifteen (15) days.

Notice of Withdrawal 

In the event of withdrawal (e.g., purchase of the wrong product), please contact us by email as soon as possible to prevent shipment and work together to find a solution. If the product has already been shipped, we will apply our standard return policy upon receipt (we will cover the return shipping costs).
The withdrawal period expires fifteen (15) days after the day on which you, or a third party other than the carrier and designated by you, physically takes possession of the item or the last item.

To exercise your right of withdrawal, you must notify us of your decision to withdraw from this contract by means of an unambiguous statement (for example, a letter sent by mail, fax, or email). You may also use the Returns Portal accessible from the website footer and select the reason “I wish to exercise my right of withdrawal,” or complete and submit the following model withdrawal form:

If you use this option, we will promptly send you an acknowledgment of receipt of the withdrawal on a durable medium (for example, by email). To ensure that the withdrawal period is met, you need only send your notice regarding the exercise of your right of withdrawal before the withdrawal period expires.

RETURN PROCEDURE

For orders placed on the Website:
You can use the Returns Portal, accessible from the website footer or from your customer account. To do so, you’ll need to enter your order number and email address.
You can also contact Customer Service via email or the contact form.
A prepaid return label will be provided for France and Belgium. For returns from countries other than France and Belgium, a return label will be provided, and the shipping costs will be deducted from your refund.
Products must be returned within 15 days of receiving notification of the return request.
Clothing must be unworn, unwashed, unaltered, with its tags attached, and returned in its original packaging. 

For purchases made in-store or via in-store pickup:
Your return must be made at the Bonnegueule store of your choice.
Items must be returned within 15 days of the purchase or pickup date.
Clothing must be unworn, unwashed, unaltered, with tags attached, and returned in its original packaging. 


Items included in promotional offers (last-chance sales, clearance sales, etc.) are not eligible for free returns. Return shipping costs will be deducted from your refund.

Effects of Withdrawal 

If you withdraw from this contract, we will refund all payments received from you, including shipping costs (except for any additional costs resulting from your choice, if applicable, a delivery method other than the least expensive standard delivery method we offer) without undue delay and, in any event, no later than fifteen (15) days from the day we are notified of your decision to withdraw from this contract. We will issue the refund using the same payment method you used for the initial transaction, unless you expressly agree to the use of a different payment method; in any event, this refund will not incur any costs for you.
We may delay the refund until we have received the goods or until you have provided proof of shipment of the goods, whichever occurs first.

You must return the item to us without undue delay and, in any event, no later than fifteen (15) days after you have notified us of your decision to withdraw from this contract. This deadline is deemed to have been met if you return the item before the fifteen-day period expires. You must bear the direct costs of returning the item.
We may refuse to refund all or part of the purchase price if the goods have depreciated in value as a result of handling beyond what is necessary to establish the nature, characteristics, and proper functioning of the goods. 





Conditions Regarding Withdrawal

The following contracts are not subject to the right of withdrawal:
For the provision of services that have been fully performed before the end of the withdrawal period and for which performance began after the consumer’s prior express consent and express waiver of their right of withdrawal;
For the supply of goods made to the consumer’s specifications or clearly personalized;
For the supply of goods that have been unsealed or damaged by the consumer after delivery and that cannot be returned for reasons of hygiene or health protection;
For the supply of digital content not provided on a tangible medium, the performance of which has begun after the consumer’s prior express consent and express waiver of their right of withdrawal.

COMPLAINTS

If you have any complaints, please do not hesitate to contact us by email (client@bonnegueule.fr). We make it a point of honor to treat all our customers with kindness and transparency, and we do everything we can to find a solution that satisfies you.


WAIVER

Our failure to insist on strict compliance with any provision of these Terms does not constitute a waiver of our right to enforce that provision at a later date. 


EVIDENCE—ELECTRONIC COMMUNICATION

Any notice or communication between you and us may be made by any electronic means and may be accepted as evidence.


GOVERNING LAW

Unless otherwise required by mandatory law, these Terms are governed by French law.
The application of the law designated above may be set aside in favor of the law of the Buyer’s country under the conditions set forth in Regulation No. 593/2008 of June 17, 2008, on the law applicable to contractual obligations.

JURISDICTION—DISPUTE RESOLUTION
We would like to inform you that, as part of the amicable procedures to which any dispute must be submitted before the matter is brought before the competent courts, we may, by mutual agreement, utilize the means provided for in Directive 2013/11/ EU of the European Parliament and of the Council of May 21, 2013, on the out-of-court resolution of consumer disputes, as well as those set forth in Regulation (EU) No. 524/2013 of the European Parliament and of the Council of May 21, 2013, on online dispute resolution for consumer disputes.
In the event that a complaint cannot be resolved amicably by our Customer Service department, and in accordance with Article L612-1 of the French Consumer Code, the Customer may, free of charge, seek assistance from the CM2C mediation service—of which BG GROUPE is a member—by email at https://cm2c.net/. The mediation service may be contacted regarding any consumer dispute that has not been successfully resolved.
Unless otherwise required by mandatory legal provisions, any dispute not resolved through amicable proceedings shall be submitted to the competent court within the jurisdiction of the Paris Court of Appeals, which shall have jurisdiction even in the case of summary proceedings, third-party claims, or multiple defendants.
